Welcome to Himalayan CRM. These Terms and Conditions (“Terms”) govern your use of the Himalayan CRM platform and services provided by Himalayan Tech Pvt. Ltd. (“Company,” “we,” “us,” or “our”), based in Kathmandu, Nepal. By creating an account, you agree to be bound by these Terms.
1. Services Provided
Himalayan CRM provides a Software-as-a-Service (SaaS) platform designed for education consultancies. Features include lead management, branch coordination, commission tracking, SMS/WhatsApp integration, and document management. We reserve the right to modify or discontinue features to improve the service.
2. Account Registration & Security
- Eligibility: You must be a registered business entity or an authorized representative to create an organization account.
- Accuracy: You agree to provide true and complete information during signup (including Gmail Auth).
- Responsibility: You are responsible for all activities under your account. You must notify us immediately of any unauthorized use. Himalayan CRM is not liable for losses caused by compromised passwords.
3. Subscription, Payments & Refunds
- Billing: Services are billed on a subscription basis (Monthly/Yearly) in NPR or USD as applicable.
- Taxes: All fees are subject to prevailing Nepali taxes (VAT/TDS) where applicable.
- Non-Payment: Failure to pay subscription fees may result in temporary suspension of access to your data.
- Refunds: We offer a 7-day money-back guarantee for first-time subscribers. Beyond this, payments are non-refundable.
4. Data Ownership & Content
- Your Data: You retain full ownership of all leads, student documents, and university contracts uploaded to the system.
- Our License: You grant us a limited license to host and process this data solely to provide the service to you.
- Backup: While we perform regular backups, you are encouraged to use our "Bulk Export" feature to maintain local copies of your critical lead data.
5. Third-Party Integrations
Himalayan CRM integrates with third-party services (e.g., Sparrow SMS, WhatsApp API, Gmail).
- You must comply with the terms of these third parties.
- We are not responsible for service outages or account bans originating from these third-party providers.
6. Prohibited Use
You may not use Himalayan CRM to:
- Store or transmit infringing, libelous, or unlawful material.
- Send "Spam" SMS or emails that violate Nepal's advertising guidelines.
- Reverse engineer the CRM platform or attempt to breach our security infrastructure.
7. Limitation of Liability
To the maximum extent permitted by Nepali law, Himalayan CRM shall not be liable for any indirect, incidental, or consequential damages, including loss of profits, data, or business opportunities resulting from the use or inability to use the service.
